Statute #SA-0003 | Open Carry Authorization Act
San Andreas State Statute #SA-0003
Enacted by: Office of the Governor, State of San Andreas
Effective Date: September 28, 2026
Section 1: Title & Purpose
This act shall officially be recorded as State Statute #SA-0003, formally designating and certifying the State of San Andreas as an Open Carry State, establishing the statutory right of qualified individuals to openly bear firearms in public spaces.
Section 2: Lawful Open Carry Defined
An individual is legally permitted to openly carry a firearm within the State of San Andreas, subject to all of the following requirements:
- (a) Licensure: The individual must possess a valid, active San Andreas Weapons License registered in their legal name.
- (b) Visibility & Method of Carry:
- Handguns and sidearms must be secured in a waist, hip, or chest holster visible to public view.
- Long guns (rifles, shotguns, and carbines) must be slung securely across the back or chest in a safe, non-threatening manner.
- (c) Legal Weapon: The carried weapon must be legally registered and not classified as prohibited or illicit under state law.
Section 3: Prohibited Areas (Gun-Free Zones)
Open carry remains strictly unlawful in the following designated locations, regardless of weapons licensure:
- Government, municipal, and judicial facilities (including City Halls, courthouses, and county administrative centers).
- Law enforcement stations, correctional facilities, and detention centers.
- Medical centers, emergency clinics, and hospitals.
- Private commercial properties where the owner or operator has visibly posted notice prohibiting firearms on the premises, or otherwise verbally prohibited them.
Section 4: Brandishing & Threatening Behavior
Nothing in this statute authorizes the unlawful display or manipulation of a firearm.
- Unholstering, holding, un-slinging, pointing, or gesturing with a firearm in an aggressive, careless, or intimidating manner without lawful justification (such as active self-defense) constitutes Brandishing a Weapon.
- Brandishing remains a Felony offense, subject to immediate arrest, weapons forfeiture, and statutory incarceration.
Section 5: Enforcement & Penalties
(a) Carrying a firearm openly without a valid weapons license is classified as a Misdemeanor offense, and carries up-to the below penalties:
Seizure of firearm(s) involved in the violation
Up to 30 days imprisonment
(b) Entering a designated Gun-Free Zone with an openly carried firearm after being notified or where signage is clearly posted constitutes Aggravated Trespass, and carries up-to the below penalties:
Seizure of firearm(s) involved in the violation
Up to 30 days imprisonment
Interaction with State Statute #SA-0001: While open carry is legal, carrying a firearm openly in an area where a crime was recently committed or reported may provide peace officers reasonable suspicion to initiate a temporary investigatory stop. Licensees remain bound by the duty to identify under #SA-0001.
APPROVED AND SIGNED INTO LAW on this 28th day of September, 2026.
