Statute #SA-0001 | Stop & Identify Statute

Section 1: Title & Purpose

This act shall officially be recorded as State Statute #SA-0001, formally certifying and designating the State of San Andreas as a "Stop and Identify" jurisdiction.

Section 2: Duty to Identify

(a) Any peace officer or law enforcement agent of the State of San Andreas who possesses reasonable suspicion that an individual has committed, is committing, is about to commit, or was involved in a crime may lawfully detain said individual and demand identification.

(b) To satisfy the requirements of this statute, the detained individual must clearly state their full legal name and date of birth. If the individual is in possession of a valid government-issued photo identification card or driver’s license, they are legally required to present it upon lawful demand.

Section 3: Prohibited Conduct

An individual commits an offense under this statute if, during a lawful detention based on reasonable suspicion, they intentionally:

• Refuse or fail to provide their full legal name and date of birth.
• Refuse or fail to surrender physical identification when currently in possession of it.
• Provide false, misleading, or fictitious identification details to a peace officer.

Section 4: Enforcement & Penalties

(a) A violation of State Statute #SA-0001 is classified as a misdemeanor offense.

(b) Failure to comply with a lawful demand under this section gives officers grounds for immediate arrest.

(c) Any individual convicted of violating State Statute #SA-0001 shall be subject to:

Executive Provision: This statute strictly applies when an officer has established reasonable suspicion for a detention. Consensual encounters do not compel an individual to present identification under State Statute #SA-0001.
